Mr. Clarke is the primary litigator for the firm. Before joining the firm in 1974, he was an Assistant United States Attorney for the District of Columbia. Since joining the firm, he has specialized in representing rail and airline labor organizations in handling matters under the Railway Labor Act and related statutes before the courts and administrative agencies. He has extensive experience in handling injunction applications, trials, appeals, and matters before the Supreme Court of the United States where he has argued five cases, including BN v. BMWE, 481 U.S. 429 (1987), in which the Court ruled that the RLA does not prohibit secondary picketing. He has also had extensive experience in handling rail and airline reorganizations, as well as arbitrations before RLA adjustment boards, including employee protection and seniority integration issues. He is also a frequent lecturer in the area of the Railway Labor Act and employee protection.
